12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TURNER DAIRY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE SERVICES.
IN NO EVENT SHALL TURNER DAIRY’S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO TURNER DAIRY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, IF ANY.
13. Indemnification
You agree to indemnify, defend, and hold harmless Turner Dairy from and against any claims, damages, liabilities, and expenses arising out of your use of the Services or violation of these Terms.
14. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Any legal action shall be brought exclusively in the state or federal courts located in Pennsylvania.
15. Class Action Waiver
You agree that any dispute with Turner Dairy shall be brought in your individual capacity only and not as a plaintiff or class member in any purported class or representative proceeding, to the extent permitted by law.
16. Modifications
Turner Dairy may modify these Terms at any time. Updated Terms will be posted on our website with a revised “Last Updated” date. Continued use of the Services constitutes acceptance of the revised Terms.
